Am i at fault if someone takes my bumper off while I am backing oup? I partly backed out and he hit me. Fault?

I was reversing out of a parkin from my apartment building. As I had backed up about 2- 2 1/ 2 ft I saw a van coming and came to a complete stop (He was about 25-30 ft away) . He came and took my bumper off and slid my car about 3 ft to the right. (he hit the backside of the car on the penger side) He then did not even stop for another 50 ft when he saw me get out of my car. I asked him if he saw me and he replied "yea, after I hit you." When the sherrif arrived on the scene, he instantly declared it my fault and wanted to give me a ticket for not "reversing correctly". Now the guy who hit me is an illegal immigrant, does not have a visa or a pport and his wife and child fled the scence. The cop did not write a report because he did not want to give "hit guy" a ticket. Now,how is this my fault again!? Just wondering if anyone knew the Florida laws on tickets in a private parking lot and also if there is something I can do to not have to pay for it? I cant pay my deductable
